In this article, the authors take up the historical figure of Dr Betty Paërl, who has surprisingly turned up in very different kinds of specialised archives. The white mathematics professor was located in IHLIA LGBT+ Heritage, the largest queer heritage collection in Europe, as a notable SM sexpert and spokesperson on transgender politics, and also found during archival research into the anti-(neo)colonial struggles of Suriname against the Dutch. Upon closer inspection of the materials, the authors find the recurrent image/item of (...) the whip that presses them to carefully think through how the archive of Dr Paërl casts light on a history that Katherine McKittrick calls being ‘in the shadow of the whip’. The article aims to combine an analysis of these versions of the whip in different visual and discursive registers to detect the liberatory politics underlying her activisms. To do so, the authors develop the intersectional model of the kaleidoscope employed by Dutch Black, migrant and refugee (BMR) feminist theorists to grasp the shifting patterns of power that Paërl battled and embodied as an activist of the anticolonial struggle, for sex workers’ rights, for kinky sex and for transgender people. This is all the more important in the historical study of transgender visual materials that most often arrive in archives via medical and police photography or pornographic materials. The historical researcher, the article argues, should be wary of (re)producing a static vision that would reduce transgender figures to sex and gender politics, or eclipse a vision of trans politics that dilates beyond sexuality. There are no egalitarians in a pandemic. The scale of the challenge for health systems and public policy means that there is an ineluctable need to prioritize the needs of the many. It is impossible to treat all citizens equally, and a failure to carefully consider the consequences of actions could lead to massive preventable loss of life. In a pandemic there is a strong ethical need to consider how to do most good overall. Utilitarianism is an influential moral theory (...) that states that the right action is the action that is expected to produce the greatest good. It offers clear operationalizable principles. In this paper we provide a summary of how utilitarianism could inform two challenging questions that have been important in the early phase of the pandemic: (a) Triage: which patients should receive access to a ventilator if there is overwhelming demand outstripping supply? (b) Lockdown: how should countries decide when to implement stringent social restrictions, balancing preventing deaths from COVID‐19 with causing deaths and reductions in well‐being from other causes? Our aim is not to argue that utilitarianism is the only relevant ethical theory, or in favour of a purely utilitarian approach. However, clearly considering which options will do the most good overall will help societies identify and consider the necessary cost of other values. Societies may choose either to embrace or not to embrace the utilitarian course, but with a clear understanding of the values involved and the price they are willing to pay. (shrink)

Human‐animal chimeras—creatures composed of a mix of animal and human cells—have come to play an important role in biomedical research, and they raise ethical questions. This article focuses on one particularly difficult set of questions—those related to the moral status of human‐animal chimeras with brains that are partly or wholly composed of human cells. Given the uncertain effects of human‐animal chimera research on chimeric animals’ cognition, it would be prudent to ensure we do not overlook or underestimate their moral status. (...) However, to assess moral status, we first need to determine what kinds of capacities are morally relevant. The standard view holds that it matters, morally, if chimeric animals develop uniquely human cognitive capacities. I argue that this view is mistaken, highlighting three problems with it: that we can think of examples of uniquely human cognitive capacities that are not morally significant, that we can think of examples of morally significant cognitive capacities that are not uniquely human, and that evidence that some cognitive capacity is shared with nonhuman animals does not undermine claims that this capacity is morally significant. We need a better framework for thinking about the moral status of part‐human beings. (shrink)

Our emotional lives are full of temporal asymmetries. Salient among these is that we tend to feel differently about painful or unpleasant events depending on their temporal location: we feel anxiety or trepidation about painful events we anticipate in the future, and relief when they are over. One question, then, is whether temporally asymmetric emotions such as relief have any ramifications for the metaphysics of time. On what has become the standard way of finessing this question, the asymmetry of relief (...) is an instance of the phenomenon of future-bias, a tendency to prefer painful events to be located in the past than in the future. The main question then posed is whether this pattern of preferences can be justified in the light of different metaphysical theories of time. In this paper I argue that this whole dialectic is misconceived. While many people may have future-biased preferences and these are a legitimate object of psychological study, this should be distinguished from the more basic phenomenon of relief that an unpleasant experience is over. Acknowledging the distinctness of these phenomena has two main consequences. First, if relief is not a manifestation of a time-biased preference, it is unclear what it would be for it to be justified or unjustified. This, in turn, should lead us to reassess how the psychology of relief bears on our metaphysical commitments. As I shall suggest, the real significance of the temporally asymmetric emotions for the metaphysics of time is that they manifest, and so reflection on them serves to draw our attention to, a structural feature of our awareness of the passage of time that resists re-articulation in other terms. Our perceptual experiences stretch across time to present us with movement, persistence and change. How is this possible given that perceptual experiences take place in the present that has no duration? In this paper I argue that this problem is one and the same as the problem of accounting for how our experiences occurring at different times can be phenomenally unified over time so that events occurring at different times can be experienced together. Any adequate account of temporal experience must (...) also account for phenomenal unity. I look to Edmund Husserl's writings on time consciousness for such an account. (shrink)

One way to make philosophy of science more socially relevant is to attend to specific scientific practises that affect society to a great extent. One such practise is biomedical research. This paper looks at contemporary U.S. biomedical research in particular and argues that it suffers from important epistemic, moral and socioeconomic failings. It then discusses and criticises existing approaches to improve on the status quo, most prominently by Thomas Pogge (a political philosopher), Joseph Stiglitz (a Nobel-prize winning economist) and James (...) Robert Brown (a philosopher of science). Finally, it sketches an alternative proposal and argues for its superiority. The proposal has four components: changing the intellectual property regime; instituting independent clinical research; aligning innovators' and patients' interests; and enacting additional regulation. In Markets Without Limits and a series of related papers, Jason Brennan and Peter Jaworski argue that it is morally permissible to buy and sell anything that it is morally permissible to possess and exchange outside of the market. Accordingly, we should open markets in “contested commodities” including blood, gametes, surrogacy services, and transplantable organs. This paper clarifies some important aspects of the case for market boundaries and in so doing shows why there are in fact moral limits to the (...) market. I argue that the case for restricting the scope of the market does not turn on the idea that some things are constitutively non-market goods; it turns instead on the idea that treating some things according to market norms would threaten the realization of particular kinds of human interests. Genomic sequencing technologies (GS) pose novel challenges not seen in older genetic technologies, making traditional standards for fully informed consent difficult or impossible to meet. This is due to factors including the complexity of the test and the broad range of results it may identify. Meaningful informed consent is even more challenging to secure in contexts involving significant time constraints and emotional distress, such as when rapid genomic testing (RGS) is performed in neonatal intensive care units. In this article, we (...) propose that informed consent matters not for its own sake, but because obtaining it furthers a range of morally important goals, such as promoting autonomy, well‐being, and trust in medicine. These goals form the basis of a new framework [PROmoting Morally Important Consent Ends (PROMICE)] for assessing the ethical appropriateness of various informed consent models. We illustrate this framework with two examples: (a) a tiered and layered consent model for obtaining consent for GS, and (b) consent for RGS in critically ill newborns. We conclude that appropriately—rather than fully—informed consent provides the correct standard for genomic medicine and research. (shrink)

Luke Semrau argues that the documented harms of existing organ markets do not undermine the case for establishing regulated systems of paid kidney donation. He offers two arguments in support of this conclusion. First, Semrau argues that the harms of kidney selling are straightforwardly amenable to regulatory solution. Second, Semrau argues that even in existing black markets, sellers would likely have experienced greater harm if the option of selling a kidney were not available. This commentary challenges both of Semrau’s claims. (...) I argue that there is no reason to believe that kidney sellers benefit from the current black market trade in organs, and highlight a number of potential issues regarding the effectiveness and feasibility of Semrau’s proposed market regulations. Does a coherentist version of rationality issue requirements on states? Or does it issue requirements on processes? This paper evalu- ates the possibility of process-requirements. It argues that there are two possible definitions of state- and process-requirements: a satisfaction- based definition and a content-based definition. I demonstrate that the satisfaction-based definition is inappropriate. It does not allow us to uphold a clear-cut distinction between state- and process-requirements. We should therefore use a content-based definition of state- and pro- cess-requirements. However, a (...) content-based definition entails that ra- tionality does not issue process-requirements. Content-based process- requirements violate the principle that ‘rationality requires’ implies ‘can satisfy’. The conclusion of this paper therefore amounts to a radical re- jection of process-requirements of rationality. (shrink)

I argue that Brierley et al are wrong to claim that parents who request futile treatment are acting against the interests of their child. A better ethical ground for withholding or withdrawing life-prolonging treatment is not that it is in the interests of the patient to die, but rather on grounds of the limitation of resources and the requirements of distributive justice. Put simply, not all treatment that might be in a person's interests must ethically be provided.

In their recent paper in this journal, Zümrüt Alpinar-Şencan and colleagues review existing dignity-based objections to organ markets and outline a new form of dignity-based objection they believe has more merit: one grounded in a social account of dignity. This commentary clarifies some aspects of the social account of dignity and then shows how this revised account can be applied to other perennial issues in bioethics, including the ethics of human embryo research and the ethics of creating part-human chimeras.

There is a curious moment in the balcony scene in Romeo and Juliet. Thinking she speaks in solitude, Juliet says, “Romeo, doff thy name, / And, for thy name, which is no part of thee, / Take all myself”. Emerging from the shadows, Romeo replies, “I take thee at thy word” (Act 2, Scene 1, 92). Suddenly, Juliet’s utterance has seemingly become binding: because they have been overheard by Romeo, her words have become her word. But is Juliet truly bound (...) by her words given that she did not know they were being overheard, let alone intend for them to be binding? Using J. L. Austin’s notion of the performative, I consider the nature and status of Juliet’s utterance, its influence on the remainder of the scene, and what insight it might afford into the play as a whole. Resumen: Deleuze y Guattari caracterizan el capitalismo como una serie de relaciones diferenciales entre flujos: trabajo / capital; medios de pago / moneda de financiamiento; códigos científicos y tecnológicos / mercado. Al mismo tiempo consideran las formas de lucha a partir del operaismo italiano. Este artículo muestra cómo se articulan ambas dimensiones de lo político a partir de establecer que son respectivamente la aplicación de los dos conceptos ontológicos fundamentales de Diferencia y repetición : la Idea diferencial y la intensidad (...) como factor de individuación. Para ello, se concentra en la relación monetaria, a partir de la teoría de los economistas que Deleuze y Guattari usan como fuente y la lucha a nivel monetario planteada por Berti.: Deleuze and Guattari characterize Capitalism as a series of differential relations between flows: labor / capital; means of payment / financing currency; scientific and technological codes / market. At the same time, they think the ways of struggle through the Italian operaismo. This paper shows the articulation of the two dimensions of politics by holding that they are an application of the two fundamental ontological concepts of Difference and Repetition : differential Idea and intensity as factors of individuation. To do that, we will focus on the monetary relation, using the theory of the economists who are source for Deleuze and Guattari and the struggle at a monetary level proposed by Berti. (shrink)

Michael Goldhaber, who popularized the term the attention economy, said of the US Capitol insurrection: “It felt like an expression of a world in which everyone is desperately seeking their own audience and fracturing reality in the process. I only see that accelerating.” If we don’t do something about this, American democracy may not survive. For when there is no longer any common ground of evidence and reason, history shows that misinformation will eventually overwhelm public discourse and authoritarianism can take (...) over. That is precisely what dictators across the world gleefully anticipate will happen in the US. The Biden administration could combat this by establishing a digital fairness doctrine for the twenty-first century. This would not mean setting up a government agency as the arbiter of truth. The purpose of such a doctrine is simply to preserve the possibility of a functioning national discourse on critical issues of public interest. It would not run afoul of First Amendment free speech guarantees, given that it would do nothing to block speech itself. In fact, it would expand and enrich national conversations, by preventing echo chambers prone to systematic bias. (shrink)

The present study sought to examine the extent to which the cultural portrayal of online gamers, often in comical, caricatured, or sensational forms, has become transformed into sets of cognitive associations between the category and traits. A total of 342 participants completed an online survey in which they rated how applicable each of a list of traits was to the group of online gamers. Ratings were made for both personal beliefs (how participants themselves see gamers) and stereotypical beliefs (how most (...) others see gamers). While these beliefs were highly consensual as stereotypes, personal beliefs varied, suggesting that the cultural portrayal of online gamers is beginning to shift into cognitive associations. The role of stereotypes in negotiating a group’s social position are discussed arguing that these stereotypes currently position online gamers as low in social status and socially peripheral. The function of the media in generating stereotypical representations of social groups and convincing the public of their validity is also discussed. (shrink)

Der Beitrag untersucht die Transformation des Vertrauensbegriffsdurch Künstliche Intelligenz. In aller Regel ist das Vertrauen in technische Artefakteeng mit deren Verlässlichkeit verbunden. Während diese Form der (technischen) Verlässlichkeit letztlich zumeist auf ein menschliches Gegenüber (z. B. auf die Herstellenden, die Betreibenden oder die Auditierenden) zurückgeführt wird, erfordert die zunehmende Präsenz von KI-Systemen eine Neubetrachtung dieses Zusammenhangs. Insbesondere bei selbstlernenden Systemen (wie der konnektivistischenKI), die ihre Auswahlkriterien und Selektionsmechanismen durch die Interaktionmit der Umwelt kontinuierlich verändern, zeichnet sich eine graduelle Verschiebungdes Vertrauens (...) ab: Vertrauen wandert, so lautet die These im Anschluss an Hartmann (2022), Schritt um Schritt vom Menschen zur Maschine. Is it Possible to Experiment with Thought? Ernst Mach’s Notion of Thought Experiment and its Pedagogical Context around 1900. The article tries to establish the crucial importance of the pedagogical dimension of Ernst Mach’s ideas on experimenting with thought. The focus on contemporary pedagogics demonstrates, first, that Mach’s didactic approach to physics is part of a much broader stream of pedagogical writings that transcends national and disciplinary borders and comprises a diversity of authors, e.g. Wilhelm Jerusalem, William James or Alfred (...) N. Whitehead; second, that the much‐heralded controversy between Mach and the French philosopher of science Pierre Duhem about thought experiments does not only revolve around epistemological issues but rather stems from their antagonist vision of teaching physics; and finally, third, that G. Stanley Hall’s psychogenetic theory of pedagogics bears a strong resemblance with the evolutionary naturalism of Machian epistemology and helps explaining key tenets of Mach’s conception of thought experiment. By establishing a broad convergence between the work of all these authors despite their different academic upbringing, background and nationality the article argues for a complex and historically fine‐grained vision of the relations between natural, social and human sciences going beyond dichotomies like ‘Erklären’ and ‘Verstehen’ or the ‘Two Cultures’. Como una alternativa a los enfoques teóricos jurídicos normalmente utilizados —como los legalistas o formalistas— para el análisis de fenómenos sociales en investigaciones sociojurídicas, en este artículo se expondrán los resultados de las reflexiones metodológicas y empíricas emanadas de una investigación cualitativa previa, en la que el autor empleó como estrategia metodológica “la observación en campo”, diferenciada de la genérica “observación participante”. En dicha investigación se analizó el proceso de resistencia que lideraron tres organizaciones sociales que tienen su rango de (...) acción en la periferia de la Comuna 8 de Medellín, por la reivindicación del derecho a la ciudad y al territorio para esta población, en medio de las obras que comprendieron la ejecución de uno de los proyectos bandera de la administración municipal de Aníbal Gaviria : el Cinturón Verde Metropolitano - Jardín Circunvalar. A través de este análisis se logró evidenciar una constante tensión entre lo local y lo global, y un trabajo mancomunado entre organizaciones de base social para resistir a una concepción hegemónica de la globalización y construir un derecho “desde abajo”. Our ordinary conception of time has it that there are temporal particulars: not only do people do things, but there are particular doings by people; not only are we born, but the birth of each one of us was a particular event, and each of us will have our own particular death. Temporal particulars in this sense are individuated, fundamentally, by their temporal locations or relations, rather than by their intrinsic or qualitative characteristics. In this respect they are unrepeatable, not (...) just de facto, but as a matter of their very nature. However, there is a tradition in philosophy that seriously downplays this aspect of our thinking about time. According to this tradition, the fundamental unit of temporal representation is _tensed truth_; the notion of an unrepeatable particular, individuated by its temporal location, is at best an abstraction from a complex of tensed truths. The aims of this paper are, first, to argue that the representation of temporal particulars is deeply implicated in our ordinary conception of the past as fixed and unalterable; and, secondly, to argue that the theorist of tensed truth is able to provide only a pale imitation of this aspect of our thinking. I will then reflect on the consequences of this for debates about the metaphysics of tense. (shrink)

It is widely believed that play and curiosity are key ingredients as children develop models of the world. There is also an emerging consensus that children are Bayesian learners who combine their structured prior beliefs with estimations of the likelihood of new evidence to infer the most probable model of the world. An influential school of thought within developmental psychology, rational constructivism, combines these two ideas to propose that children learn intuitive theories of how the world works in part by (...) engaging in play activities that allow them to gather new information for testing their theories. There are still, however, at least two pieces missing from rational constructivist theories of development. First, rational constructivism has so far devoted little attention to explaining why children's preferred form of learning, play, feels so fun, enjoyable, and rewarding. Rational constructivism may suggest that children are curious and like to play because reducing uncertainty and learning better theories of the causal workings of the world is enjoyable. What remains unclear, however, is why reducing uncertainty in play is interesting, fun, and joyful, while doing so in other forms of learning can be frustrating or boring. Second, rational constructivism may have overlooked how children, during play, will take control of and manipulate their environment, sometimes in an effort to create ideal niches for surprise-extraction, sometimes for developing strategies for making the world fit with their predictions. These missing elements from rational constructivism can be provided by understanding the contribution of play to development in terms of predictive processing, an influential framework in cognitive neuroscience that models many of the brain's cognitive functions as processes of model-based, probabilistic prediction. Synaesthesia is a neurodevelopmental condition characterised by anomalous sensory perceptions and associated alterations in cognitive function. This chapter summarises what is known about the familial transmission of synaesthesia and its genetic underpinnings. Early familiality studies showed evidence for a strong genetic predisposition, a highly skewed female: male ratio, and an absence of male-to-male transmission. These patterns supported an early hypothesis of a single-gene X-linked dominant mode of inheritance with male lethality. Subsequent analyses in larger samples indicated that the mode of (...) inheritance was likely to be more complex, with both the strong female skew and absence of male-to-male transmission brought into question. We review in detail the first whole genome linkage scan for auditory-visual synaesthesia and a subsequent family linkage study on coloured sequence synaesthesia. Together these results suggest linkage to five chromosomes but give no support for linkage to the X-chromosome. We discuss candidate genes within these regions and potential implications for the aetiology of synaesthesia. We also discuss the implications of these pioneering genome scans for our understanding of synaesthesia and of how different synaesthetic phenotypes may arise from different genetic predispositions interacting with other genes and with the environment. This article proposes to analyze the idea of organism and other closely related ideas using a combination of semantic fields analysis from conceptual history and the notion of boundary objects from the sociology of scientific knowledge. By tackling a wide range of source material, the article charts the nomadic existence of organism and opens up new vistas for an integrated history of the natural and human sciences. First, the boundaries are less clear-cut between disciplines like biology and sociology than previously (...) believed. Second, a long and transdisciplinary tradition of talking about organismic and societal systems in highly functionalist terms comes into view. Third, the approach shows that conceptions of a world society in Niklas Luhmann's variant are not semantic innovations of the late twentieth century. Rather, their history can be traced back to organicist sociology and its forgotten pioneers, especially Albert Schäffle or Guillaume de Greef, during the last decades of the nineteenth century. Different sciences approach the brain-behaviour system at various levels, but often apparently share terminology. “Function” is used both ontogenetically and phylogenetically. Within the ontogeny it has various meanings; the one adopted by Arbib et al. is that of mainstream cognitive psychology. This usage is relatively imprecise, and the psychologists who are sceptical about the ability of cognitive psychology to predict behavioural outcomes may have the same reservations about Arbib et al.'s cognitive neuroscience.

En el Fedón, tras ofrecer numerosos argumentos a favor de la inmortalidad del alma, se introduce un mythos acerca de su vida ultraterrena. Dado el tenor del tema en cuestión y las limitaciones humanas para dar con un logos estrictamente verdadero al respecto, Sócrates y sus allegados acuerdan en que se debe buscar el “más difícil de refutar” (85d1) entre los logoi humanos. Este trabajo intenta determinar en qué medida la asociación entre el mito presentado hacia el final del diálogo (...) y los argumentos precedentes contribuye a ese objetivo. En este sentido pretende mostrar, por un lado, que el mito mencionado posee los caracteres atribuidos a la noble mentira en R. II-III –texto que plantea la necesidad de acudir a relatos que, aunque ficticios, resultan útiles para instaurar la justicia en el alma del auditorio–; y, por el otro, que en virtud de su carácter persuasivo, el mito contribuye a fortalecer el logos hasta allí desarrollado para volverlo lo más irrefutable posible, generando confianza en la necesidad de llevar adelante una vida virtuosa, inclusive en el auditorio que no forma parte del círculo filosófico. Marxism’s Unintentional Contributions to the Renewal of Human Rights in Post-1968 France. The years following May 1968 witnessed the end of a certain chapter of French Marxism and a return to the languages of human rights and liberalism. French Marxism itself unintentionally contributed to this development. This article examines three overlapping cases from the 1970s : Maoism and mobilization around prisons, the women’s movement and the law, and the New Philosophers’ undermining of a dialectical view of history.
